1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Trinity Alps Farms, Inc., DBA Hash and Flowers (“Hash & Flowers,” “we,” “us” or “our”), concerning your access to and use of the shop.hashandflowers.com online shop, our informational website at hashandflowers.com, and any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). These Terms govern both your browsing of the Site and any purchase you make through it. Our Privacy Policy and Cookie Policy are incorporated into these Terms by reference.

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Who we are: The Site is operated by Trinity Alps Farms, Inc., DBA Hash and Flowers, Trinity County, CA, which holds California Department of Cannabis Control license C12-0000296-LIC (Commercial Microbusiness, Adult-Use + Medicinal). You can reach us at info@hashandflowers.com.

2. Eligibility and Age Verification

a) Age Requirement: The Site is intended solely for individuals who are at least twenty-one (21) years of age. Persons under the age of 21 are not permitted to use, register for, or purchase from the Site.

b) Verification: You must confirm your age to enter the Site and provide your date of birth to register an account. These online steps are not the final check: on every order, a member of staff or the delivery driver checks your valid government-issued photo identification in person at pickup or delivery, to confirm that you are 21 years of age or older and that you are the person who placed the order. We or our licensed retail partners will refuse to complete any order where age or identity cannot be verified.

c) Permitted Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms for your personal, non-commercial use. Products purchased through the Site may not be resold or supplied to any person under 21 years of age.

3. Products and Legal Compliance

The Site offers cannabis and cannabis-related products. All sales are conducted in compliance with California law and are fulfilled by licensed cannabis retailers. Products are available only to customers located in the State of California within our service areas, and may not be transported across state lines. Cannabis remains subject to restrictions under U.S. federal law. You are responsible for complying with all laws applicable to your purchase, possession, and use of the products, including applicable possession limits.

4. Customer Accounts

You may need to register an account to place orders. You agree to provide accurate, current, and complete information (including your legal name and date of birth), to keep it updated, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that provide false information, share credentials, or otherwise violate these Terms or applicable law.

5. Orders, Pricing, and Payment

a) Orders: Placing an order constitutes an offer to purchase. All orders are subject to acceptance, product availability, delivery-area eligibility, regulatory purchase limits, and successful age and identity verification. We may refuse, limit, or cancel any order at our discretion, including where we suspect fraud or a violation of these Terms or applicable law. If we cancel an order after payment has been made, we will refund the amount paid.

b) Pricing and Taxes: All prices are stated in U.S. dollars and are subject to change without notice. Applicable taxes, including cannabis excise tax and sales tax, and any delivery fees are shown at checkout and included in your order total.

c) Payment: Payment is collected at the time of delivery or pickup. We currently accept cash on delivery or at pickup; available payment methods are shown at checkout. Minimum order amounts may apply to delivery orders in certain areas and are shown before you place your order.

6. Delivery and Pickup

a) Delivery: Delivery is available only to physical addresses within our eligible California service areas. Deliveries must be received by the customer who placed the order, who must be present, at least 21 years of age, and able to present valid government-issued photo identification matching the order. Delivery personnel may refuse to complete a delivery where identification cannot be verified, where the recipient appears visibly intoxicated, or where completing the delivery would violate applicable law. A refused or failed delivery may result in cancellation of the order.

b) Pickup: Pickup orders must be collected at the selected licensed retail location by the customer who placed the order, subject to the same identification requirements.

c) Title and Risk: Title to and risk of loss for products pass to you upon handover of the products to you at delivery or pickup.

7. Cancellations, Returns, and Refunds

a) Cancellations: You may cancel an order free of charge at any time before it has been prepared for pickup or dispatched for delivery, through your account or by contacting us at info@hashandflowers.com.

b) Returns and Refunds: Because cannabis products are regulated, all sales are final once products have been handed over to you, except as required by applicable law. If you receive a defective, damaged, mislabeled, or incorrect product, contact us within seventy-two (72) hours of delivery or pickup and we will arrange a replacement, store credit, or refund as appropriate and as permitted by law. Nothing in these Terms limits any rights you have under applicable consumer-protection law.

8. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions.

The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

9. Prohibited Conduct

You agree not to use the Site to:

  • Purchase or attempt to purchase products for or on behalf of any person under 21 years of age, or resell products purchased through the Site.
  • Engage in any activity that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Scrape, crawl, or use any automated means to access the Site or collect data.
  • Attempt to gain unauthorized access to the Site, user accounts, or computer systems.
  • Transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
  • Interfere with or disrupt the Site or the servers or networks connected to the Site.
  • Impersonate any person or entity, provide false identification or age information, or otherwise misrepresent your affiliation with a person or entity.
  • Violate any applicable local, state, national, or international law.
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

10. Links to Third-Party Websites

The Site may contain links to other websites or resources operated by parties other than us (“Third-Party Websites”). Such Third-Party Websites are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any content posted on, available through, or installed from the Third-Party Websites. If you decide to leave the Site and access Third-Party Websites, you do so at your own risk, and you should be aware these Terms of Use no longer govern.

For clarity, websites we operate — including hashandflowers.com and shop.hashandflowers.com — are not Third-Party Websites, and these Terms of Use govern your use of the Site and your purchases regardless of how you reached it.

11. Disclaimers

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SITE AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Site; (2) your breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

14. Governing Law

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.

15. Dispute Resolution

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each a “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating any court action. Such informal negotiations commence upon written notice from one Party to the other Party.

Any Dispute that is not resolved through informal negotiations shall be brought exclusively in the state courts located in Trinity County, California or, where federal jurisdiction exists, in the United States federal courts located in the State of California. Each Party irrevocably consents to the personal jurisdiction of, and venue in, such courts and waives any objection on the ground of inconvenient forum. Nothing in this Section prevents either Party from bringing an eligible individual claim in small claims court or from seeking injunctive or other equitable relief to protect its intellectual property rights.

16. Miscellaneous

If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. We may assign any or all of our rights and obligations under these Terms to others at any time. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the use of the Site.

17. Changes to These Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Effective Date” of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
